Terms & Conditions of Pravesika

Welcome to the Pravesika (the “Platform”). These terms and conditions govern your use of the platform as a candidate. These terms and conditions will be incorporated and will be enforceable to the same extent as the terms of the physical contract. As these “Terms and Conditions” constitute a legal agreement we request you to please carefully read these T&C applicable and additional T&C may be constituted in future. Eligibility

1. By accepting these terms and conditions or otherwise using the platform, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
2. You are solely responsible for ensuring that you meet the eligibility criteria set by the colleges where you intend to apply.

Registration

1. To use the platform, you must create an  account by providing accurate and complete registration information.
2. After successful completion of the registration process, you will be redirected to the payment gateway where you will be required to make the payment. Confirmation of the payment will be sent to you through your registered email along with an admit card.
3. You are responsible for maintaining the confidentiality and security of your account information.
4. You agree to provide true, accurate, and up-to-date information during the registration process.
5. Any violation of these Terms may result in the termination of your account.

Examination Process

1. The Platform allows you to register for and participate in the entrance exams conducted by various colleges.
2. You must comply with the rules and guidelines provided by each college regarding the examination, including but not limited to the timing, format, and conduct of the exam.
3. The Platform provides necessary information about the exams, such as Program Name, exam schedules, exam centers, duration, and exam fee, to help you make informed choices.
4. The Platform does not guarantee admission to any college or guarantee the accuracy, completeness, or availability of information regarding the exams or colleges.
5. You should arrive at the exam center before the scheduled exam time. You will need to bring all the required documents by yourself.

Fees and Payment

1. There may be registration or examination fees associated with using the Platform, as determined by the colleges and communicated to you during the registration process.
2. You are solely responsible for paying any applicable fees and ensuring that your payment information is accurate and up-to-date.
3. The Platform may use third-party payment processors to handle transactions. Any disputes or issues related to payments should be addressed directly with the respective payment processor.

Privacy

The Platform collects and processes personal information in accordance with its Privacy Policy. By using the Platform, you consent to the collection, storage, and use of your personal information as described in the Privacy Policy.

Refund Policy

All payments are final with no refund or transfer permitted. You recognize and agree that you shall not be entitled to a refund under any circumstances.

Ownership: Intellectual Property

1. The Platform and its content, including but not limited to text, graphics, logos, images, and software, are protected by intellectual property rights.
2. You may not reproduce, distribute, modify, or create derivative works of any content on the Platform unless expressly permitted.

Disclaimer

1. The Platform is provided on an “as is” basis without warranties of any kind, whether express or implied.
2. The Platform does not guarantee the accuracy, completeness, or reliability of any information on the Platform or the results of any exams conducted through the Platform.
3. We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Platform or the exams conducted through it.
4. We are not responsible for the content available on our linked websites. All the links are only provided for information and we ascertain that we do not endorse any information provided by the website linked to us.
5. We will take all the necessary steps to ensure the confidentiality of the information provided by the students for admission purposes. All data stored manually or electronically will be used only for the intended purpose of entrance examination and no other purpose.
6. At any point of time, you are free to terminate our services, provided you have met the conditions of the termination.

Termination

1. The Platform reserves the right to suspend or terminate your account and access to the Platform at any time, without prior notice, for any reason or no reason at all.
2. Upon termination, your right to use the Platform ceases, and any permissions granted to you under these Terms shall also terminate.

Amendment of this Agreement

1. Khalti has the sole discretion to change, modify, add or remove portions of these Terms and Conditions.
2. Your continued use of the Platform after any such changes shall constitute your acceptance of the modified Terms and Conditions.

Notice

Khalti may provide you with notices and communications by email, regular mail or postings on the website www.pravesika.com or via push notifications or by any other reasonable means.

Except as otherwise set forth herein, notice to Khalti must be sent by courier or registered mail to Khalti Private Limited, Hariharbhawan, Pulchowk, Lalitpur, Nepal GPO Box : 8975, EPC: 1887.

Governing Laws and Jurisdictions

1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal.
2. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved amicable. Where the disputes can not be resolved through mutual discussion, the disputes shall be resolved in accordance with the provisions of the Arbitration Act, 2055.
3. Any arbitration shall be confidential, and you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of the arbitration award.

Indemnification

Both the Parties agrees to defend, indemnify, save, and free their officers, agents and employees against any or all losses, injuries, claims, actions, causes of action judgments or liens arising from or alleged to have arisen from the misconduct, negligence or willful default or breach of this Agreement by its officers, agents, or employees. The indemnification shall survive the termination.

Severability

If any provision of this Terms and Conditions is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from this Terms and Conditions to the minimum extent required, and the remaining provisions will remain valid and enforceable.

Entire Agreement

This is the entire agreement between You and Khalti relating to the subject matter hereof and will not be modified except in writing, signed by both parties, or by a change to this Agreement made by Khalti in accordance with the Terms and Conditions.

By using the Pravesika Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
